1. About these Terms
These Terms and Conditions (Terms) apply to your use of the SISKA website at www.shopsiska.com (Website) and to any purchase you make through the Website.
The Website and SISKA online store are operated by Kiss Active Pty Ltd trading as SISKA (SISKA, we, us or our), ABN 66755271511 of 2/6 Fortitude Cres, Burleigh Heads.
By accessing or using the Website, creating an account or placing an order, you agree to these Terms and our Privacy Policy, Shipping Policy and Returns Policy. If you do not agree, you must not use the Website.
These Terms do not exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
2. Eligibility and permitted use
You may only use the Website and purchase products for lawful purposes. If you are under 18, you may only place an order with the involvement and consent of a parent or legal guardian.
You must not:

use the Website for any unlawful, fraudulent or unauthorised purpose;

interfere with the security, operation or integrity of the Website;

introduce malicious code, viruses or other harmful material;

scrape, copy, reproduce or commercially exploit Website content without our prior written permission;

attempt to gain unauthorised access to any part of the Website or another person's account; or

use the Website in a way that infringes the rights of SISKA or any third party.
We may suspend or restrict access to the Website where we reasonably believe these Terms have been breached or where necessary to protect the Website, SISKA or other users.
3. Website information and product descriptions
We take reasonable care to ensure that information on the Website is accurate and current. However, to the extent permitted by law, information may occasionally contain errors, inaccuracies or omissions.
Product images are provided for illustration. We make reasonable efforts to display colours accurately, but the colour shown on your device may vary depending on your screen settings, lighting and device. Product measurements are approximate unless stated otherwise.
All descriptions, prices, promotions and availability may be updated from time to time. Nothing in this section limits any right you may have where a product does not match its description, sample or other representation made by us.
4. Product availability and purchase limits
Products are subject to availability. Placing an item in your cart does not reserve that item. We may apply reasonable purchase limits to particular products, launches, promotions or customers, including to support fair access and prevent suspected resale, fraud or misuse.
If a product becomes unavailable after you place an order, we will contact you and provide an appropriate remedy, which may include a refund for the unavailable product.
5. Prices, GST and currency
Unless stated otherwise, prices displayed on the Website are in Australian dollars (AUD) and include GST where applicable. Delivery charges and any other applicable charges will be shown at checkout before you submit your order.
For international orders, your bank or payment provider may charge currency conversion or transaction fees. You are responsible for any import duties, taxes or customs charges imposed by the destination country unless we expressly state otherwise at checkout.
We may change prices at any time before an order is accepted. If a product is listed at an incorrect price due to a genuine error, we may contact you before accepting or fulfilling the order and give you the option to purchase at the correct price or receive a full refund. We will not use this clause to avoid an order merely because a promotion or advertised price is commercially unfavourable to us.
6. Placing an order and formation of contract
When you submit an order, you are making an offer to purchase the selected products on these Terms. An automatic order confirmation acknowledges that we have received your order but does not necessarily mean that we have accepted it.
A contract for the sale of products is formed when we accept your order by sending a dispatch confirmation or otherwise notifying you that the order has been accepted. Each order may be accepted or declined separately.
Before acceptance, we may decline or cancel an order on reasonable grounds, including where:

a product is unavailable;

there is an obvious pricing or product information error;

payment is not authorised or cannot be processed;
-
we reasonably suspect fraud, misuse, unauthorised resale or a breach of these Terms; or
-
we cannot deliver to the address provided.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products using the original payment method, unless another method is agreed with you.
7. Payment
You must provide complete and accurate billing and payment information and confirm that you are authorised to use the selected payment method.
Payments are processed through third-party payment providers. Their terms may also apply to your transaction. We do not store complete payment card details unless expressly stated in our Privacy Policy.
If you use a buy now, pay later service, your agreement with that provider is separate from your purchase agreement with us. Any refund will be processed in accordance with our applicable policy and the provider's procedures.
8. Order details and changes
You are responsible for checking your order, delivery address and contact information before submitting it. Please contact us as soon as possible if you need to request a change or cancellation.
We will try to assist, but we cannot guarantee changes or cancellations after an order has been accepted, packed or dispatched. This does not affect any rights you have under the Australian Consumer Law.
9. Shipping and delivery
Our Shipping Policy, available on the Website, forms part of these Terms and explains our delivery options, charges and estimated timeframes.
Delivery timeframes are estimates unless we expressly agree to a fixed date. We will take reasonable steps to dispatch and deliver orders within the stated or otherwise reasonable timeframe. Delays may occur due to circumstances outside our reasonable control, including carrier delays, severe weather, customs processing or service disruptions.
You must provide a complete and accurate delivery address. Where permitted by law, additional delivery costs caused by an incorrect or incomplete address may be charged to you after we notify you.
Risk in a product passes to you when the product is delivered to you, your nominated recipient or a location you have specifically authorised, except to the extent otherwise required by law. Title passes once we have received full payment.
10. Returns, exchanges and change of mind
Our Returns Policy, available on the Website, forms part of these Terms and explains any additional change-of-mind returns or exchanges that SISKA voluntarily offers.
Any eligibility periods or conditions stated in our change-of-mind policy apply only to change-of-mind returns. They do not limit your rights regarding faulty, unsafe, incorrectly described or otherwise non-compliant products under the Australian Consumer Law.
Unless required by law or expressly permitted by our Returns Policy, we are not required to accept a return because you changed your mind, selected the wrong size or no longer want the product.
11. Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. These include guarantees that products will be of acceptable quality, match their description and any sample or demonstration model, and be fit for any disclosed purpose where the law applies.
If a product fails to comply with a consumer guarantee, you may be entitled to a repair, replacement, refund or compensation, depending on whether the failure is major or minor and on the circumstances. Nothing in these Terms or our policies excludes, restricts or modifies those rights.
Normal wear and tear, misuse, accidental damage, failure to follow care instructions or damage caused by using a product in a way it was not designed for may not amount to a failure to comply with a consumer guarantee. Each claim will be assessed on its facts and in accordance with applicable law.
To raise a product issue, contact us using the details in section 23 and provide your order details and a description of the issue. We may reasonably request photographs or other information to assess the claim. We will not require you to contact a manufacturer instead of us where we are legally responsible for providing a remedy.
12. Promotions, discount codes and gift cards
Additional terms may apply to a promotion, competition, discount code, gift card or special offer. If there is an inconsistency, the specific promotional terms apply to that promotion to the extent of the inconsistency.
Unless stated otherwise:
-
discount codes must be entered at checkout and cannot be applied after an order is placed;
-
only one discount code may be used per order;
-
codes are not redeemable for cash and must not be resold;
-
promotions are available only during the stated period and while stocks last; and
-
discounts do not apply to delivery charges, gift cards or excluded products.
We may cancel or refuse a discount or promotional benefit where we reasonably determine that it has been obtained through error, fraud, manipulation or a material breach of the applicable terms. Nothing in this section permits us to withdraw a valid promotion contrary to the Australian Consumer Law.
Gift cards are subject to the terms displayed at purchase or supplied with the card, including any expiry period permitted by law.
13. Pre-orders
Products identified as pre-order items are expected to be dispatched on or around the estimated date shown on the relevant product page. Estimated dates may change for reasons such as production, freight or customs delays.
If there is a material delay, we will provide an update and any options required by law. Where an order contains both in-stock and pre-order products, the entire order may be held until all products are available unless we state otherwise.
14. Accounts
You may be able to create an account on the Website. You are responsible for keeping your login details confidential and for activity carried out through your account, except where that activity results from our act or omission or another matter for which the law makes us responsible.
You must provide accurate information and promptly update it when necessary. Please notify us immediately if you suspect unauthorised use of your account.
We may suspend or close an account on reasonable grounds, including suspected fraud, security risks or serious or repeated breaches of these Terms. Where reasonably practicable, we will notify you.
15. Intellectual property
Unless otherwise stated, the Website and its content—including the SISKA name and branding, logos, product names, text, graphics, photographs, videos, designs, layout and software—are owned by or licensed to SISKA and are protected by intellectual property laws.
We grant you a limited, revocable, non-exclusive and non-transferable licence to access and use the Website for personal, non-commercial shopping purposes. No other right or licence is granted.
You must not reproduce, adapt, distribute, publish, sell, license or otherwise exploit our intellectual property without our prior written permission, except as permitted by law.
16. Reviews and user content
If you submit a review, photograph, comment, social-media tag or other content to us or directly to the Website (User Content), you confirm that:

you own or control the necessary rights to that content;

the content is genuine and not false, misleading, defamatory, unlawful or infringing; and
-
the content does not contain malicious code or another person's confidential or personal information without permission.
You retain ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt and display it in connection with SISKA's Website, products and marketing, subject to applicable law and our Privacy Policy. You may contact us to withdraw permission for future use, although this will not necessarily require us to recall or alter material already lawfully produced or published.
We may moderate or remove User Content where we reasonably believe it breaches these Terms or applicable law. We will not suppress genuine reviews merely because they are negative.
17. Third-party services and links
The Website may contain links to, or integrations with, third-party websites and services, including payment, delivery and social-media services. Those third parties may apply their own terms and privacy policies.
Unless required by law, we are not responsible for third-party websites or services that we do not control. A link does not necessarily mean that we endorse the third party.
18. Website availability
We aim to keep the Website available and secure, but do not guarantee uninterrupted or error-free access. We may temporarily suspend or modify the Website for maintenance, security, updates or events outside our reasonable control.
To the extent permitted by law, we are not liable for loss caused solely by temporary unavailability that is outside our reasonable control. This section does not limit liability that cannot lawfully be excluded.
19. Liability
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability under the Australian Consumer Law or any other law where doing so would be unlawful.
Subject to the paragraph above, and to the maximum extent permitted by law:

we are not liable for indirect or consequential loss that was not reasonably foreseeable at the time the relevant contract was made; and

we are not liable for loss caused by your unlawful use of the Website, your breach of these Terms, or your failure to take reasonable steps to avoid or reduce the loss.
Any limitation in these Terms applies only to the extent it is fair, reasonable and legally enforceable in the circumstances.
20. Privacy
We handle personal information in accordance with our Privacy Policy, available on the Website. By using the Website, you acknowledge that you have had an opportunity to review that policy.
21. Changes to these Terms
We may update these Terms from time to time to reflect changes to our business, the Website, our practices or applicable law. Updated Terms will be posted on the Website with a revised “Last updated” date.
Changes apply to future use of the Website and future orders from the time they are posted. The terms applying to an order already accepted will not be changed retrospectively unless required by law or agreed with you.
22. General
If any provision of these Terms is held to be invalid or unenforceable, it will be read down to the extent necessary or severed, and the remaining provisions will continue to apply.
Our failure or delay in exercising a right is not a waiver of that right.
These Terms are governed by the laws of Queensland, Australia. You and SISKA submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them. Nothing in this section prevents you from exercising any right you may have under applicable consumer law in another Australian state or territory.
